Terms of Use

These conditions govern access to and use of this website. Browsing its content or submitting a search means that you accept all terms stated below. If you disagree with any condition, you must stop using the website.

NO FCRA USE. Pender County Criminal History is privately operated and has no connection to a local, state, or federal agency. This website and its advertising partners do not provide a service for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act (FCRA). The content identifies public criminal-record resources in Pender County and North Carolina. It is neither a private-investigation service nor a consumer reporting agency.

1. What This Website Is

This is a privately run reference website, not a government service. It does not possess official records, obtain records for a visitor, perform an official background check, or submit forms on another person's behalf.

The content directs readers to the actual custodians of Pender County records, such as the sheriff, the North Carolina courts, the North Carolina State Bureau of Investigation (SBI) Criminal Information and Identification Section, and the North Carolina Sex Offender and Public Protection Registry. Access to agency records is governed in part by the North Carolina Public Records Law, Chapter 132, together with record-specific exceptions. Outside tools may also be linked as research options.

2. Rules for Using This Site

As a condition of use, you must not:

  • Use the website in violation of federal, North Carolina, or local law
  • Harass, stalk, intimidate, or threaten anyone with information found here
  • Rely on this content for a credit, employment, housing, or insurance decision
  • Attempt unauthorized entry into any website account, server, or system
  • Deploy a bot, scraper, or similar automated collection tool on these pages
  • Interfere with website performance or another visitor's access

3. No Harassment, Stalking, or Discrimination

You may not use information from these pages or any linked tool to stalk, threaten, harass, intimidate, or unlawfully discriminate against another person. Such conduct may also violate criminal law. North Carolina places special limits on misuse of information from the North Carolina Sex Offender and Public Protection Registry. That registry supports public-safety awareness and does not authorize vigilantism, blacklisting, or discriminatory conduct against a listed person.

4. We Are Not a Consumer Reporting Agency

Pender County Criminal History is not a consumer reporting agency under the FCRA and does not create credit reports, background checks, or any other consumer report. Its advertising partners likewise do not offer tools here for FCRA-regulated screening. You agree that information from this website or a linked tool will not be used to:

  • Make an employment decision about another person
  • Evaluate an applicant for housing or a lease
  • Set credit terms, credit eligibility, or insurance pricing
  • Decide eligibility for a license, permit, or public benefit
  • Carry out any other purpose regulated by the FCRA

When a lawful purpose requires an official check, follow the applicable North Carolina SBI process or use a provider that complies with the FCRA.

5. No Legal Advice

The material is general information, not legal advice. It cannot determine how a pending charge, conviction, warrant, or North Carolina expunction law applies to a particular set of facts. Seek advice from a licensed North Carolina attorney for that analysis.

6. No Warranties

All content and functions are supplied "as is." No promise is made that:

  • Information will always be complete, correct, or up to date
  • Access will remain continuous or uninterrupted
  • The pages will contain no defect, bug, or security weakness
  • An outside search provider will return complete or accurate results

Criminal records can change when a charge is filed, amended, dismissed, sealed, or expunged. Delays and gaps can occur. No statement here should be treated as an official certification from the Pender County Sheriff, a North Carolina court, SBI, or any other government custodian.

7. Third-Party Services and Links

Links may point to a sheriff's website, an eCourts service, another state agency, a legal-aid resource, or an outside search provider. Following a link takes you to a service that we do not operate. We are not responsible for its content, privacy practices, price, availability, or results. Review the destination's own terms first.

8. Intellectual Property

Text, graphics, logos, and code are owned by Pender County Criminal History or the applicable content partner. They may not be copied, changed, distributed, or used to create another work without prior written authorization.

9. Limits on Our Liability

To the maximum extent permitted by law, we disclaim liability for loss or damage arising from website use, including reliance on content obtained here or from an external service.

10. Indemnification

You agree to indemnify and hold us harmless against a claim, demand, or legal proceeding caused by your website use or your breach of these conditions, including related costs and reasonable legal fees.

11. Governing Law

North Carolina law governs these terms, including applicable consumer-protection rules such as N.C. G.S. 75-1.1. Any lawsuit concerning use of the website must be brought in a court located in North Carolina.

12. Changes to These Terms

These terms may be revised at any time. A revision becomes effective when the updated text is posted to this page.

13. Cutting Off Access

Access may be suspended, restricted, or terminated at any time, for any reason, without advance notice.

14. Severability

If a court finds one provision invalid or unenforceable, all remaining provisions continue in effect. The affected language will be modified only to the extent needed to make it enforceable.

15. Questions

Questions concerning these conditions may be submitted through the Contact page.
